RiseUp Overseas – Terms of Service

By accessing the applications, portals, or platforms, including but not limited to riseupoverseas.com and any other platforms launched from time to time (collectively referred to as the “Website”, “Platform”, or “Application”), you acknowledge that these are developed, operated, and maintained by RiseUp Overseas (hereinafter referred to as “The Company”, “we”, “our”, or “us”). The Company’s registered office is located at Surat, Ahmedabad, and Vadodara. Your use of this platform constitutes your unconditional agreement to be legally bound by the following terms and conditions, along with any incidental or related policies.

Before using the Platform, you must carefully read and accept these Terms and Conditions (“Terms”), the Privacy Policy, and any additional legal disclaimers applicable to your jurisdiction. To use our Platform, you must be at least 18 years of age. By accessing or using the Platform, you warrant that you meet this age requirement. Users below 18 years must register under the supervision of their Parent(s) or legal guardian(s).

The terms “you,” “user,” or “your” refer to any individual, institution, organization, partner, student, agency, or other entity accessing or utilizing this platform.

The Company reserves the sole right to modify, amend, or update these Terms at any time without prior notice. Your continued use of the Platform after such changes signifies your acceptance of the revised Terms.

1. General Provisions

1.1 Severability & Jurisdiction

If any provision of this Agreement is found invalid or unenforceable, the courts of Ahmedabad, India shall have exclusive jurisdiction to interpret the Parties’ intent. The remaining terms shall remain in full effect.

1.2 Headings & Interpretation

Section headings are for reference only and do not affect interpretation. The Company’s failure to enforce a breach does not waive future rights.

1.3 Entire Agreement

This Agreement supersedes all prior agreements and governs your use of RiseUp Overseas’ services. No third-party beneficiaries are conferred unless explicitly stated.

2. Services & User Responsibilities

2.1 Service Description

RiseUp Overseas facilitates higher-education admissions in Europe and select destinations, offering:

  • University shortlisting & application support
  • Visa guidance & documentation assistance
  • Pre-departure counseling

2.2 User Obligations

  • Provide accurate, verifiable information (academic records, contact details, etc.).
  • Consent to data processing required for service delivery, including sharing with partner institutions.
  • Refrain from unauthorised use of Platform content (intellectual property, trademarks, third-party resources).

2.3 Account Security

Users are responsible for maintaining account confidentiality. Report unauthorised access immediately. False information may result in termination.

3. Intellectual Property & Confidentiality

3.1 Ownership

All platform content, trademarks, and technology remain RiseUp Overseas’ exclusive property. Reverse-engineering or redistribution is prohibited.

3.2 Data Use

User data may be processed for service delivery, analytics, and compliance with legal requirements.

4. Liability & Indemnification

4.1 Limitation of Liability

  • Third-party actions (universities, embassies, etc.).
  • Technical errors, data loss, or force majeure events.
  • Damages exceeding fees paid for services.

4.2 Indemnity

Users agree to indemnify RiseUp against claims arising from breaches of this Agreement.

5. Dispute Resolution & Governing Law

5.1 Amicable Settlement

Disputes shall first be resolved through good-faith negotiations within 30 days.

5.2 Arbitration

Unresolved disputes will be arbitrated in Ahmedabad under Indian law. Courts in Ahmedabad retain exclusive jurisdiction.

6. Termination & Force Majeure

6.1 Termination

RiseUp may suspend services for non-compliance. Fees are non-refundable for voluntary withdrawals or misrepresentation.

6.2 Force Majeure

Neither party is liable for failures due to unforeseeable events (e.g., natural disasters, political unrest).

7. Miscellaneous

7.1 Updates to Terms

RiseUp may modify these Terms; continued use constitutes acceptance.

7.2 Acceptance

By using the platform, users confirm they have read, understood, and agreed to these Terms.
